Judge Issues Temporary Stay For Argosy

DES MOINES, IA - (UPDATE) A Polk County judge issues a temporary stay for Argosy.  The Riverboat Casino can stay opened until the July 10th hearing in Des Moines.

The Iowa Racing and Gaming Commission has denied the request to keep the casino open, and has been ordered to close July 1st.
 
Attorney Mark Weinhardt argued on behalf of Penn National Gaming, "People like to gamble, for one month there will be no destination to gamble in Sioux City." Weinhardt also asked if Argosy and Hard Rock could both be open saying, "It's better for the city, if both facilities were open."

Tomorrow, District Court Judge Ovrom will hear oral arguments from attorneys in this case on whether to issue a stay at a hearing at the Polk County Courthouse in Des Moines.

Karen Bailey, spokeswoman for Penn National Gaming says, "We were hopeful that the IRGC would give more thoughtful consideration for our appeal for an emergency stay. If not for any other reason than the fact that the new casino won't be open until the beginning of August thus costing the state and local governments a month of revenue for no real reason. We remain hopeful for a better outcome in tomorrow's hearing especially in light of the bankruptcy judge's written opinion that finds we are in fact licensed and that the IRGC waived its contention with that very question in express correspondence with us, in public statements and when they took the various actions on our application."

Meanwhile, the new Hard Rock Casino Hotel is still on schedule to open August 1st.
