Judge Rules Bernstein E-mails Can Remain Private

DES MOINES, IA -

A judge has ruled in favor of Missouri River Historical Development board member Dave Bernstein when it comes to the handling of documents wanted by lawyers representing the Argosy Casino.

The judge in Des Moines granted a "protective order", which means the documents requested of Bernstein will still be made available to lawyers for Penn National Gaming, but they can't be made public.

Previously, Penn had posted emails and correspondence on its website that were obtained in conjunction with the suit. The judge also denied a request by Penn to sanction Bernstein.

Penn has filed a breach of contract lawsuit against MRHD, which tossed its support behind the new Hard Rock Casino and Hotel.
