BPI Lawsuit Moves Forward

ELK POINT, SD -

A Union County judge has dismissed motions by ABC News in the lawsuit filed by Dakota Dunes-based Beef Products Incorporated against the national media company for damages related to ABC's use of the term "pink slime" in news reports about BPI's Lean Finely-Textured Beef product.

BPI claims in the lawsuit that ABC's reporting damaged their business, forcing them to close three of their processing plants and lay off 700 employees.

ABC had been seeking to have the lawsuit dismissed.

The rulings mean the lawsuit can now proceed to trial.

BPI is seeking $1.2 billion dollars in damages from ABC.

Erik Connolly, representing BPI, said in a statement to Siouxland News "We are pleased with the Court's decision, which rejected nearly all of the Defendants' arguments. We look forward to starting discovery and ultimately presenting our case to a jury."
