IA Supreme Court Orders Review of Hard Rock License Stay

SIOUX CITY, IA -

There's been yet another legal ruling in the battle over gambling rights in Sioux City; the third in just two months.

The Iowa Supreme Court has sent back to Polk County District Court the issue of whether Judge Robert Hanson had the authority to grant a stay of the gaming license handed out by the Iowa Racing and Gaming Commission to the developer of the Hard Rock Casino, Sioux City Entertainment.

Meanwhile, Justice Brent Appel's earlier decision to lift that lower court order will remain in effect.

The Supreme Court ordered Judge Hanson to hold a hearing on the matter, and issue a ruling, by February 15th.

The high court also suggested scheduling changes be made to move the case along more quickly.

The president of Sioux City Entertainment, Bill Warner, issued a statement saying "We are grateful to the Iowa Supreme Court for their continued review of this matter. We will proceed in accordance to the order as this matter returns to the District Court. We are pleased the Supreme Court has left intact their stay of the earlier stay."
